  • I think I may need to get a lawyer

    This crazy lady that pulled out in front of me is still fighting she is at fault. Our insurance is going to arbitration and she's fighting her ticket she received for failure to yield. My head hurts. I'm mad. I just want this to be over. But she thinks she's not at fault what-so-ever. I have a feeling this is going to get dragged out.

      If she got the ticket, there's not much she can fight, IMO, pretty much done deal.

        I'm thinking the same thing. Even if she gets out of legal liability, it doesn't mean she isn't civilly liable. Although the legal thing helps.

          Did your insurance pay your claim then subrogate against the person at fault? That's how some companies do it. You may have to pay your deductible and then they will give it back to you after they get money from the person at fault. That way, no hassle on your end.

            My insurance took care of me and did not make me pay the deductible for the repairs. They are going after her insurance but hers is not claiming liability because she is lying to her insurance, so they are hearing two different stories...hence the arbitration. she's also fighting the ticket that she received. I got a summons for her court date in November. I will not be missing it.

              Glad your insurance stepped up and is helping you out. That's great customer service. I don't see that she has a leg to stand on with the ticket given to her, but you never know. Yes, definitely go to the court appearance. I'm sure it will work out.

                Your insurance has good lawyers. Show up to the court date, give your side of the story and it should all play out like it's supposed to.
